Marital Property and Debt Division in Florida Divorce
At the office of W. David Vaughn, Esq., I don't often have the chance to advise my divorce clients about their rights to the family business or second home. Instead, my clients are usually more concerned about limiting their liability on marital debt while protecting their interest in the homestead. If you're an ordinary working person who needs advice about basic property division and marital debt issues in a divorce case, I'm the lawyer for you. In advising my divorce clients, I look just as hard at the debts and liabilities as I do the assets of their marriages. For many divorcing people, how much debt you're going to end up with will be a much more important issue than making sure that you're getting your fair share of the property.
In most cases, there isn't much equity in the house and the rest of the assets are exempt from the claims of your creditors anyway. If the financial strains of unpaid bills or even the threat of bankruptcy damaged your marriage to the point of divorce, it makes more sense to concentrate on a fair division of the marital debts than it does to argue over the car and the furniture.
Florida is an equitable distribution state, which means that a family court judge will be more interested in making a fair division of property and debts than a strictly equal one. I can work with you and help you define your objectives in terms of what's possible under Florida law. Then I can execute a property and debt division strategy that gives you the best chance of achieving your goals.
Reduce marital debt through the sale of an “upside down” home
In an age of deflating real estate values, many of my divorce clients need help with the sale of a marital home that's worth less than the mortgage balance. I can help ensure that you won't be stuck with liability for the difference by negotiating a short sale or other modification terms with your mortgage lender.
